In Luxembourg, more than 1,800 inspections have been carried out in the HoReCa sector in the last five years
In response to a request from MPs Carole Hartmann and Corinne Cahen, the Luxembourg Ministry of Labour provided data on inspections in the HoReCa sector over the last five years.
- Inspections carried out: from 2020 to 2024, the Inspectorate of Labour and Mines (ITM) carried out 1,857 inspections.
- Requests to bring conditions into compliance: 4,068 notices to correct violations were issued.
- Sanctions: 558 fines were imposed for employing workers without authorisation or in other violations.
ITM actively informs employers and employees about their rights and obligations. In 2024, the following events were held:
- Campaigns to change labour laws;
- Training sessions on health and safety rules in the workplace;
- Individual counselling to improve working conditions.
The issue of "gaps in the working day" attracted particular attention. According to the Labour Code, the break between shifts cannot exceed three hours, except in cases approved by the ITM, with mandatory consideration of the employees' opinion. Since 2021, 182 exceptions have been approved.
Labour Minister Georges Mischo stressed the importance of striking a balance between compliance with legislation and adaptation to the specificities of the HoReCa sector. Despite strict controls, no regulatory changes are planned yet, but monitoring and consultation will continue.
